EMPLOYER SPONSORED TSS visa (Temporary Skill Storage visa)

The Temporary Skill Shortage (TSS) visa (subclass 482) is an employer-sponsored visa that allows skilled workers to come to Australia and work for an approved employer for up to four years. This visa program replaced the Temporary Work (Skilled) visa (subclass 457) in March 2018.

Key Points about the TSS visa:
  1. Employer Sponsorship: To apply for this visa, you must be sponsored by an approved employer who can demonstrate a genuine need for your skills. The employer must also meet certain requirements regarding labor market testing and providing terms and conditions of employment that are in line with Australian workplace standards.
  2. Occupation List: Your occupation must be on the relevant skilled occupation list (Medium and Long-term Strategic Skills List, Short-term Skilled Occupation List, or Regional Occupation List) and meet the relevant skill level requirements.
  3. English Language Proficiency: Depending on the stream of the TSS visa, you may need to demonstrate English language proficiency by providing evidence of having achieved a certain score on an approved English language test such as IELTS, TOEFL, PTE Academic, or Cambridge English.
  4. Work Experience and Skills: You must have the necessary skills and work experience relevant to the nominated occupation.
  5. Salary Threshold: There is a minimum salary threshold that you must be paid, which is determined based on the Annual Market Salary Rate (AMSR) for your occupation.
  6. Health and Character Requirements: You and any family members included in your application must meet health and character requirements. This usually involves undergoing health examinations and providing police clearance certificates.
  7. Visa Streams: There are three streams under the TSS visa:
    • Short-Term Stream: Allows employers to sponsor skilled workers for occupations listed on the Short-term Skilled Occupation List for a maximum duration of up to two years.
    • Medium-Term Stream: Allows employers to sponsor skilled workers for occupations listed on the Medium and Long-term Strategic Skills List (MLTSSL) for a maximum duration of up to four years.
    • Labour Agreement Stream: For employers who have negotiated a labor agreement with the Australian government, allowing them to sponsor workers for occupations and terms specified in the agreement.
  8. Nomination and Visa Application: The process involves three stages: nomination by the employer, visa application by the applicant, and approval by the Department of Home Affairs. It's important to note that the requirements and processes for the TSS visa may change over time, so it's advisable to check the official website of the Department of Home Affairs or consult with a migration agent for the most up-to-date information.
